Navigating the regulations surrounding ballast water management can be a complex and challenging task for mariners. With the adoption of Resolution MEPC.387(81) on March 22, 2024, there is now clear guidance on the application of the BWM Convention to ships operating in challenging water quality conditions.

One important issue that arises in these conditions is the need for a Dispensation Letter before bypassing the Ballast Water Treatment System (BWTS). The resolution introduces two types of bypasses: Reactive and Pre-Emptive, each with their own set of steps and requirements.

A reactive bypass occurs when unforeseen CWQ issues arise while operating or upon arrival at port. In this case, no Dispensation Letter is required, and the situation and corrective actions must be recorded in the Ballast Water Record Book.

On the other hand, a pre-emptive bypass is planned in advance when the BWTS will be inoperable at a particular port due to CWQ conditions. In this case, a Dispensation Letter must be obtained before arriving at the port, and the receipt of the letter and bypass use must be recorded in the BWRB.

Understanding the distinction between these two types of bypasses is crucial for maintaining compliance with the BWM Convention and ensuring efficient operations. It is also important to stay informed on the evolving regulations surrounding ballast water management and to maintain accurate records to safeguard marine ecosystems.
